General Terms and Conditions (GTC) INTERSPORT PÖTSCHER (IP)
1. Scope
These terms and conditions are the framework agreement between IP and the interested parties/customers and are the basis for all offers, services and sales of goods. In addition, special terms and conditions may regulate special aspects.
2. Conclusion of contract
The advice given to customers prior to the conclusion of the purchase is based on their self-assessment, without objectification.
The contract is concluded by handing over the service/goods and simultaneous payment by the customer, or by handing over the invoice.
Customer requirements can only be changed from this point in agreement with IP. Minor deviations from advertising or exhibits, especially if due to product progress, do not constitute a defect.
3. Retention of title
The goods remain the property of IP until all claims arising in this business transaction have been paid in full.
For the duration of the retention of title, the customers bear the full risk for the goods, in particular also the risk of destruction, loss or deterioration.
In the event of access by third parties to the reserved goods, the customers must point out the retention of title and inform IP immediately.
If the customer is in default of payment, IP is entitled to take back the goods subject to retention of title and is then obliged to issue a credit note for 80% of the current value.
4. Operating instructions/Instructions for use
IP refers to the manufacturer's instructions for proper use. Should the customers wish to receive additional instruction, this does not release the customers from internalizing these product instructions BEFORE STARTING UP the goods. Care and maintenance instructions should be followed as closely as possible.
5. Warranty, damages
IP assumes no warranty for defects or damages resulting from normal wear and tear and improper handling (see also point 4.).
IP does not grant any warranty/damages beyond the mandatory statutory provisions.
6. Place of jurisdiction
Austrian law shall be applied to all disputes arising from business transactions subject to these General Terms and Conditions, to the exclusion of the conflict of law rules of international private law and the UN Sales Convention. The BG Freistadt has local jurisdiction.
7. Severability clause
The possible invalidity of individual provisions of these General Terms and Conditions shall not affect the validity of the remaining provisions. For this invalid provision, the contracting parties agree to agree on a new provision that comes as close as possible to the purpose of the previous one.
