General Terms and Conditions for Sweepstakes

1) The organizer of this competition is INTERSPORT Johann Pötscher GmbH (hereinafter referred to as "organizing company"). By participating in the competition, the participant agrees to the following terms and conditions. In the case of a Facebook competition: Competitions are in no way connected to Facebook, they are neither sponsored, supported nor organized by Facebook. All questions, comments or complaints about the competition should be directed exclusively to the organizing company and not to Facebook. The organizing company releases Facebook from all liability claims in relation to the competition. The recipient of the information provided by the participant is not Facebook, but the organizing company.

2) Persons who have reached the age of 18 and have their permanent residence in Austria are eligible to participate. Registration with complete and correct personal data, in particular name, address, e-mail address and age, may be required for participation (apart from competitions on Facebook, here the participation modalities in the Facebook post must be followed). This data is temporarily stored and processed by the organizing company, but not passed on to third parties without the participant's consent. The name of the participant/winner (in particular their Facebook name) will be published on the INTERSPORT Pötscher Facebook page together with any submitted photos, texts or other contributions. The organizing company reserves the right not to publish or delete submitted contributions (photos, texts or other contributions). Persons who have not yet reached the age of 18 (minors) may require the consent of their legal representative (parents) to participate.

3) Participation is free of charge and independent of the purchase of products or services from the organizing company. Employees of the organizing company and their relatives are excluded from participation. In the event of exclusion from the competition (also according to point 8), prizes can also be revoked and reclaimed retrospectively.

4) The participant assures that he has all rights of use - in particular for duplication, distribution, editing and making available - to the submitted contributions, that their publication does not violate the rights of third parties, in particular no personal rights of depicted persons, and that he is therefore entitled to publication and the subsequent granting of rights. Should the organizing company nevertheless be held liable for the violation of the rights of third parties to the submitted contributions, the participant shall indemnify and hold the organizing company harmless in this regard.

5) The participant grants the organizing company free of charge, non-exclusively, spatially and temporally unlimited and transferable all rights of use, in particular for duplication, distribution, editing, making available, to the submitted contributions (photos, texts or other contributions). The contributions can be used independently of the media for reporting, advertising and public relations of the organizing company. The participant also agrees that the posted images and texts may also be discussed and linked via the organizing company and third parties in social media (especially Facebook).

6) The prizes to be won in the respective competition and the participation deadline will be announced by the organizing company in individual cases (e.g. Facebook Post). The winners will be determined within one week after the closing date for entries among all eligible participants by lot. A cash payment, exchange or transfer of prizes is not possible. Only one prize can be won per participant. If circumstances arise for which the organizing company is not responsible, the respective winner accepts a reasonable substitute prize. Such circumstances for which the organizing company is not responsible are in particular those that lie with the sponsors of the prizes. Legal recourse is excluded.

7) The prize must be redeemed by the participant within one month and collected personally in an INTERSPORT Pötscher shop. In any case, however, the winner must first contact the organizing company via Facebook. After the 30-day period has expired, the participant can no longer claim his prize from the organizing company. By accepting the prize, the winner agrees that the organizing company may use his name and, if applicable, a photo of the handover for advertising purposes.

8) A violation of these terms and conditions of participation entitles the organizing company to exclude the respective participant from participation in the competition. This applies in particular if the participant provides false information or used photos or other content (e.g. comments) violate applicable law or the rights of third parties. The same applies to comments that can be regarded as glorifying violence, offensive, harassing or degrading or otherwise violate social decency. If the excluded participant is an already drawn winner, the prize can be revoked retrospectively.

9) The organizing company reserves the right to terminate the competition at any time, even without observing deadlines, prematurely in whole or in part or to change its course if it is not possible to guarantee the proper execution of the competition for technical reasons (e.g. computer virus, manipulation or errors in software/hardware) or legal reasons (e.g. prohibition by Facebook).

10) The organizing company is responsible for the collection, processing and use of personal data of the participants, provided that the organizing company processes this itself. The organizing company will use the information on the person of the participant as well as his other personal data only within the framework of the legal provisions of data protection law. The organizing company will only store, process and use the information to the extent that this is necessary for the execution of the competition or the participant has given his consent. This also includes use for the exercise of the granted rights of use. The data will be used exclusively for the execution of the competition and then deleted.

11) Should the terms and conditions of participation contain ineffective provisions, the effectiveness of the conditions shall remain unaffected in all other respects.

12) Austrian law applies. A legal recourse to review the draw is excluded.
