Special Terms and Conditions Bicycle (Seasonal) Rental (Tenant and Landlord are gender-neutral synonyms)

User Obligations

Upon conclusion of the contract, all users of the rental property must be listed in the rental agreement. Transfer to others is not permitted.

Each user must use the bicycle in a design-typical manner. Unless expressly agreed otherwise, use is limited to 1 person. The total payload is max 100kg, only for bicycles of the brand KTM and Cube, the payload is limited to max 125kg for selected models.

Each user is responsible for their own fitness to drive and undertakes to have familiarized themselves with the relevant legal provisions (STVO, KFG, FG etc.).

The user is solely liable for damage caused to third parties.

Before each use, the user must perform a function check; Tire condition, braking force, chain functionality, frame strength, and refrain from using it in case of defects.

The user is strongly recommended to wear protective devices such as bicycle helmets, back protectors, protective gloves, etc. when starting up; this for health protection as well as against contributory negligence objections.

Maintenance

Maintenance work and repairs are to be carried out by the landlord; should this not be reasonable, alternatively by a knowledgeable specialist company in consultation with the landlord.

Any modifications to the bicycle are prohibited. In the event of repair, only model-typical original parts may be used. Performance-enhancing upgrades are prohibited. (e.g. batteries with higher performance, braking system etc.)

Custody Obligation

The rental object must without exception be locked to fixed, solid objects with insurance-compliant theft protection. This is present if the purchase price was demonstrably €50.00 or more, or a lock rented from the landlord (free with the carefree package) is used.

The locking obligation does not apply if the bicycle is kept in a locked room that is only accessible to family members. (e.g. garage). In the event of theft, the tenant must replace the current value of the bicycle.

This point does not apply if a carefree package is concluded, provided that the bicycle has been used and secured in accordance with the contract.

In any case of theft, the tenant must immediately file a theft report with the responsible police station and send it to the landlord.

Damage

This point does not apply if a carefree package is concluded, provided that the bicycle has been used in accordance with the contract.

In all other cases, the tenant must either bear the actual repair costs or replace the bicycle at the respective current value of the rental object.

Security Deposit

To ensure his identity, the tenant hands over a copy of a photo ID.

The landlord reserves the right to demand a security deposit in cash in the rental offer.

Return

The tenant is obliged to return the bicycle no later than the last day of the rental period within our opening hours. The daily rental fee will be charged for each day exceeding the rental period.

The condition of the bicycle upon return must correspond to that upon acceptance.
